Terms of Use for Tactiq

Please read these Terms of Use (“Terms”) carefully before using the Tactiq application (“App”) and the Tactiq Chess website (“Website”), together the “Service”, operated by Tactiq (“we,” “our,” or “us”).

By downloading, installing, or using the App, or by using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms. You may not:

• Copy, modify, or distribute the App or any part of it.
• Reverse engineer, decompile, or disassemble the App.
• Rent, lease, lend, sell, or sublicense the App.
• Copy, extract, reproduce, or redistribute any part of the App’s database content, whether free or paid, in any form or by any means.
• Use the Service for any unlawful or unauthorized purpose.

3. User Accounts

You may use the App with an anonymous account or by signing in with Google. The Website does not require an account. If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Purchases

The App may offer subscription plans (“Premium” and “Pro”) and in-app purchases through Google Play. By purchasing a subscription, you agree to the following:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Payment is charged to your Google Play account upon confirmation of purchase.
• You can manage or cancel your subscriptions through Google Play Store settings.
• Refunds are handled in accordance with Google Play’s refund policies.

5. User Content and Data

You retain ownership of any data you create or store within the App, such as game statistics and preferences. By using cloud synchronization features, you grant us permission to store and process this data on our servers solely for the purpose of providing the Service to you. Progress recorded on the Website is stored only in your browser.

6. Prohibited Activities

You agree not to engage in any of the following activities:

• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
• Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure.
• Uploading invalid data, viruses, worms, or other harmful software through the Service.
• Using the Service to harass, abuse, or harm another person.
• Using the Service in any manner that could disable, overburden, damage, or impair it.
• Using any automated system, including “robots,” “spiders,” or “offline readers,” to access the App or to bulk-download content from the Website. Ordinary search-engine indexing of the Website is permitted.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Tactiq and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Database Content

The App’s database content, including but not limited to all free and paid data, collections, and compilations, is the exclusive intellectual property of Tactiq. Copying, extracting, scraping, reproducing, or redistributing any part of the database, whether in its original form or a derivative work, is strictly prohibited and may result in immediate termination of your access and legal action.

Open Data and Third-Party Materials

Individual puzzle positions are derived from the Lichess puzzle database, which is published under the CC0 public-domain dedication; nothing in these Terms restricts your rights in that original data. Chess piece graphics are used under the BSD licence of their author. Open-source software used by the Service is subject to its respective licences.

8. Third-Party Services

The Service may use third-party services, including but not limited to:

• Google Play Services
• Firebase
• Cloudflare (hosting and analytics for the Website)

Your use of such third-party services is subject to their respective terms and conditions.

9. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tactiq, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Service.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your use of the App at any time by uninstalling it from your device.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
